What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears.

The ruling

The tenancy is terminated effective June 25, 2021. The tenant shall pay the landlord $-1,740.71, which represents the rent owing to June 14, 2021 and the landlord's filing fee, less the rent deposit and interest owing on the deposit. The tenant shall also pay the landlord $65.75 per day in compensation for the use of the unit from June 15, 2021 to the date she vacates. If the tenant does not pay the full amount owing by June 25, 2021, she will owe simple interest calculated from June 26, 2021 at 2.00% annually on the balance outstanding. The order will be void, and the tenancy will not terminate, if the tenant pays $1,686.00 to the landlord or the Board on or before June 25, 2021.
