What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears. The tenant had not vacated the rental unit as of the hearing date.

The ruling

The tenancy will be terminated on January 15, 2023 unless the Tenant pays the outstanding rent arrears of $4,828.42 by November 30, 2022, $7,145.90 by December 31, 2022, or $9,463.38 by January 15, 2023. If the Tenant does not void the order, they must move out by January 15, 2023 and pay the Landlord $883.08, which includes the rent arrears and application filing fee, minus the rent deposit and interest.
